PETALZ MOSAIC END USER LICENSE AGREEMENT (EULA)

This End User License Agreement (“Agreement”) is a legal agreement between you (“User,” “you”) and Petalz Mosaic Inc. (“Petalz,” “we,” “us,” or “our”) governing your use of the Petalz Mosaic mobile application and related services (the “App”).
By downloading, installing, accessing, or using the App, you agree to be bound by this Agreement. If you do not agree, do not use the App.
1. License Grant
Petalz grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices that you own or control, solely for your personal, non-commercial use, in accordance with this Agreement and any applicable marketplace terms governing your download of the App.
You may not:
- Copy, modify, distribute, sell, lease, or sublicense the App
- Reverse engineer, decompile, or attempt to extract source code
- Use the App for unlawful or unauthorized purposes
2. Ownership
The App and all related intellectual property rights are owned by Petalz Mosaic Inc. This Agreement does not grant you ownership of the App or its content.
3. User Accounts and Responsibilities
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Ensuring that any content you upload complies with this Agreement
You must not use the App in a way that harms, abuses, or infringes the rights of others.
4. User-Generated Content
The App allows users to upload and share content such as photos, videos, messages, and information (“User Content”).
By submitting User Content, you:
- Retain ownership of your content
- Grant Petalz a limited license to store, process, and display the content solely to operate and provide the App’s services
You agree not to upload content that:
- Is unlawful, harmful, abusive, defamatory, or misleading
- Violates privacy or intellectual property rights
- Contains malware or malicious code
Petalz reserves the right to remove content that violates this Agreement or applicable law.
5. Privacy
Your use of the App is subject to our Privacy Policy , which explains how we collect, use, and protect personal information.
The Privacy Policy is available within the App and on our website.
6. Subscriptions and Purchases
Some features of the App may require a paid subscription or in-app purchase.
- Payments made through the App are processed by the applicable app marketplace provider (such as Apple’s App Store or Google Play Store).
- Subscriptions automatically renew unless cancelled through your account settings with the applicable marketplace provider.
- Petalz does not directly process billing or issue refunds for subscriptions purchased through an app marketplace.
For subscriptions purchased through an app marketplace, the applicable marketplace provider is responsible for billing, payment processing, and subscription management.
7. Acceptable Use
You agree not to:
- Use the App for commercial solicitation without authorization
- Attempt to access systems or data not intended for you
- Interfere with the App’s operation or security
Petalz may suspend or terminate access if you violate this Agreement.
8. Termination
This Agreement is effective until terminated.
Petalz may terminate or suspend your access at any time if you breach this Agreement. Upon termination, your right to use the App will cease.
9. Disclaimer of Warranties
The App is provided “AS IS” and “AS AVAILABLE.”
To the maximum extent permitted by law, Petalz disclaims all warranties, express or implied, including fitness for a particular purpose and non-infringement.
10. Limitation of Liability
To the extent permitted by law, Petalz shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of data, content, or access
- Issues arising from third-party services, including Apple
11. Apple & Google -Specific Terms
Apple App Store Users
If you download the App from Apple’s App Store:
- This Agreement is between you and Petalz Mosaic, not Apple Inc.
- Apple is not responsible for the App or its content.
- Apple has no obligation to provide maintenance or support services for the App.
- Apple is a third-party beneficiary of this Agreement and may enforce its terms against you.
- If the App fails to conform to any applicable warranty, you may notify Apple for a refund in accordance with Apple’s policies.
Google Play Users
If you download the App from Google Play, your use of the App is also subject to Google Play’s terms and conditions.
12. Changes to This Agreement
Petalz may update this Agreement from time to time.
If material changes are made, users may be required to review and accept the updated terms before continuing to use certain features.
13. Governing Law
This Agreement is governed by the laws of Canada, without regard to conflict of law principles.
